Raymond BeckTown Council Members, I work part-time for Pinal County, the Public Defender's Office. Occasionally, we represent clenits who have major finanical problems, and receive a DUI arrest. The legislature allowed local cities to opt out of the required 30 days jail for a 2nd offense, and substitute house arrest. Judges cannot do that unless the local city approves it. Can you put this on your October agenda? Scottsdale, Tucson and some other cities have approved doing this. In particular, we have a client who may lose his children to CPS, if he has to do 30 days jail. House arrest in place of jail would prevent that. He has sole custody. Also, the legistlaure requires that the DUI defendant pay for jail costs. They range from $70 to over $100 a day. Most defendants cannot afford that for 30 days jail. House arrest reduces the fines to something manageable. Statistics seem to show DUI defendants pay only half the jail costs. Cities get stuck with the remainder of the bill. House arrest as an option, could save cities and counties money. Thank you for considering this, Sincerely, Raymond Beck Pinal county deputy public defender (retired, working part time in Mammoth Justice Coury)
